Terms of Service

These Terms of Service ("Terms") govern your use of the website rashadmd.com ("Site") and the consultation services ("Services") provided by Essam Rashad, MD ("we," "us," or "Dr. Rashad"). By accessing the Site or engaging Services, you agree to these Terms. Please read them carefully.

1. Nature of Services

The Services offered through this Site consist of independent medical consultations, second-opinion reviews, executive longevity assessments, and hospitalization advocacy. These Services are consultative in nature and are intended to provide informed medical opinion, education, and analysis to support your decision-making in coordination with your existing healthcare providers.

2. No Doctor-Patient Relationship for Primary Care

Engaging our Services does not establish a primary doctor-patient relationship for ongoing medical care. Dr. Rashad does not assume responsibility for your continuous medical management, prescription refills, emergency care, or routine treatment. Your existing physicians remain responsible for your ongoing healthcare. The consultation is advisory and is not a substitute for hands-on medical care from your treating providers.

3. Not Emergency Care

The Services are not intended for medical emergencies. If you are experiencing a medical emergency, including but not limited to chest pain, difficulty breathing, severe bleeding, suicidal thoughts, or any life-threatening condition, call 911 immediately or proceed to the nearest emergency department. Do not use this Site or these Services in lieu of emergency medical care.

4. Eligibility & Geographic Limitations

You must be at least 18 years of age to engage Services on your own behalf, or you must be the legally authorized representative of the patient. Some Services are limited by state telemedicine regulations. Consultations involving specific medical advice or recommendations may only be available to residents of states in which Dr. Rashad is licensed to practice medicine. Where state regulations limit the scope of consultation, Services may be provided as educational opinion only. Eligibility will be confirmed during intake.

5. Fees & Payment

All fees are listed in U.S. dollars and are payable in full at the time of booking through our secure payment processor. Fees are non-negotiable. Payment is required before any Service is rendered. We do not accept insurance for these Services. We may, upon request, provide a superbill that you may submit to your insurance carrier; however, we make no representation regarding whether your insurance will reimburse any portion of fees paid.

6. Cancellation & Refund Policy

Refund requests must be submitted in writing to hello@rashadmd.com. Refunds are processed within 10 business days to the original payment method.

7. Records, Information, and Honesty

You agree to provide accurate, complete, and honest medical information, including all relevant records, medications, and history. The quality and reliability of any consultation is directly limited by the completeness of the information provided. We are not responsible for opinions, recommendations, or assessments rendered based on incomplete or inaccurate information you have supplied.

8. Limitations of Consultation

Dr. Rashad will decline to provide consultation on cases that fall outside his areas of clinical competence, including but not limited to pediatric cases, primary surgical decisions, deeply specialized oncology, and primary psychiatric care. In such cases, we will refund any fees paid (less administrative costs) and refer you to appropriate specialists where possible.

9. Written Deliverables

Where a Service includes a written clinical assessment, the assessment is delivered within 5 business days of the consultation unless otherwise stated. The written assessment is intended for your personal use and to share with your treating physicians. The written assessment reflects Dr. Rashad's professional opinion based on information available at the time of consultation; it is not a guarantee of any clinical outcome and is not intended for legal proceedings, disability determinations, or insurance disputes unless explicitly arranged in advance.

10. Disclaimers

Medicine is inherently uncertain. Recommendations and opinions provided through our Services represent Dr. Rashad's professional judgment based on the information presented and current medical knowledge but do not guarantee any specific clinical outcome. Different physicians may reach different reasonable conclusions on the same facts.

The Site, its content, and the Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, except as required by law.

11. Limitation of Liability

To the fullest extent permitted by law, in no event shall Dr. Rashad's total liability arising out of or related to the Services exceed the amount paid by you for the specific Service giving rise to the claim. We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.

Nothing in these Terms limits liability for negligence resulting in personal injury or for any liability that cannot be excluded under applicable law.

12. Confidentiality & Privacy

Your health information will be handled in accordance with our Privacy Policy and HIPAA Notice of Privacy Practices, both of which are incorporated by reference into these Terms.

13. Intellectual Property

All Site content — including text, graphics, logos, written assessments, and any educational materials — is the property of Dr. Rashad or its licensors and is protected by copyright and other intellectual property laws. Written assessments are licensed to you for your personal medical and informational use. You may share them with your treating physicians but may not republish, reproduce commercially, or distribute publicly without written permission.

14. Site Use

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to the Site or its systems; (c) interfere with the proper functioning of the Site; (d) impersonate another person; (e) submit false or misleading intake information; or (f) use automated tools to scrape Site content.

15. Third-Party Services

The Site uses third-party services including, without limitation, payment processing (Stripe), hosting providers, and analytics. Your interactions with these services are governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.

16. Indemnification

You agree to indemnify and hold harmless Dr. Rashad, his employees, and contractors from any claims, damages, or expenses arising from: (a) your violation of these Terms; (b) misrepresentation of medical information; (c) your use of the written assessment beyond its intended scope; or (d) actions taken or not taken in reliance on the consultation that constitute medical decisions properly made in conjunction with your treating physicians.

17. Modifications to Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last Updated" date. Continued use of the Site or Services after changes constitutes acceptance of the revised Terms.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association in Dallas County, Texas, except that either party may seek injunctive relief in a court of competent jurisdiction. You agree to resolve disputes individually and waive the right to participate in any class action.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with the Privacy Policy and HIPAA Notice, constitute the entire agreement between you and Dr. Rashad regarding the Services and supersede all prior agreements and understandings.
